CPCB E-Waste Producer Registration under E-Waste (Management) Rules, 2022: Complete Guide

Electronic waste (e-waste) is one of the fastest-growing waste streams in India. To ensure its environmentally sound management and promote a circular economy, the Ministry of Environment, Forest and Climate Change (MoEFCC) notified the E-Waste (Management) Rules, 2022, effective from 1 April 2023. 

Under these Rules, eligible producers of Electrical and Electronic Equipment (EEE) are required to register on the CPCB EPR Portal and fulfil their Extended Producer Responsibility (EPR) obligations. 

If your business manufactures, imports, or sells electrical and electronic equipment under its own brand, obtaining CPCB E-Waste Producer Registration is mandatory. 

What is E-Waste Producer Registration? 

  • E-Waste Producer Registration is the process through which eligible producers obtain registration from the Central Pollution Control Board (CPCB) on the E-Waste EPR Portal
  • The registration provides a unique EPR Registration Certificate and assigns EPR targets that producers must fulfil through authorised recycling and proper e-waste management. 

Who is Considered a Producer? 

According to the E-Waste (Management) Rules, 2022, a Producer includes any person or entity that: 

  • Manufactures electrical and electronic equipment under its own brand. 
  • Sells products manufactured by others under its own brand. 
  • Imports used electrical and electronic equipment. 

If your business falls under any of these categories, CPCB registration is mandatory. 

Is CPCB Registration Mandatory? 

Yes. 

  • Every producer covered under the E-Waste (Management) Rules, 2022 must register on the CPCB EPR Portal before carrying out business. 
  • Entities already holding EPR Authorisation under the old E-Waste (Management) Rules, 2016 are also required to register under the new portal. 
  • Registered entities are permitted to deal only with other registered manufacturers, recyclers, refurbishers, and producers. 

Validity of Registration 

  • The Producer Registration Certificate remains valid for 5 years. 
  • For renewal, the application should be submitted at least 120 days before the expiry of the registration. 

Documents Required for Producer Registration 

The following documents are generally required: 

  • Company Name and Legal Details 
  • GST Certificate 
  • PAN Card 
  • IEC (Import Export Code), if applicable 
  • CIN/Incorporation Certificate 
  • Details of the Authorised Person 
  • Corporate Office Address 
  • List of applicable EEE Categories 
  • Financial year-wise sales data 
  • Chartered Accountant (CA) Certificate

  • Self Declaration

Sales Data Requirement 

One of the most important requirements is the submission of historical sales data.

  • Financial year-wise sales quantity 
  • Data in Metric Tonnes (MT) 
  • Sales corresponding to the average life of the product 
  • CA-certified sales figures 

The information submitted is used by CPCB to determine EPR obligations. 

RoHS Compliance 

During registration, producers are also required to declare compliance with the Restriction of Hazardous Substances (RoHS) provisions. 

They must maintain technical documents demonstrating compliance and produce them whenever required by CPCB or SPCB officials. 

Producer Responsibilities After Registration 

After obtaining registration, producers are responsible for: 

Meeting annual EPR targets. 

  • Channelising e-waste to authorised recyclers. 
  • Maintaining RoHS compliance. 
  • Conducting consumer awareness programmes. 
  • Maintaining records and submitting information on the CPCB portal. 
  • Dealing only with registered stakeholders. 

CPCB Processing Timeline 

As per the Standard Operating Procedure (SOP): 

  • Complete applications are generally processed within 30 working days. 
  • Incomplete applications receive a deficiency notice through the portal. 

Applicants must submit the required corrections within the prescribed timeline to avoid delays. 

Can Registration Be Revoked? 

Yes. 

CPCB may revoke the registration if: 

  • False information is submitted. 
  • Important information is concealed. 
  • The producer violates the provisions of the E-Waste (Management) Rules, 2022. 

In addition, environmental compensation and other legal actions may also be initiated.
